Terms of service
These terms apply when your company signs up for and uses SureWork.
The service
SureWork is a workspace for South African small and medium businesses to run their people, pay and books: employee records and BCEA leave, time and attendance, documents and e-signatures, calendars, payroll, consultants placed with clients and billed from their hours, recruitment with a public careers page, accounting, reports, and support. Which modules your company can use depends on its plan. Everything is provided within the app: SureWork prepares statutory figures and files, such as the EMP201 figures, the EMP501 with IRP5/IT3(a) certificates and the VAT201 figures, but your company remains responsible for checking them and submitting them to SARS itself.
Your account and trial
Signing up creates a private workspace for your company. New workspaces start with a free 32-day trial with the Enterprise plan’s features, and no card is required to begin. If no plan has been paid for when the trial ends, the workspace is paused until the Owner chooses a plan and pays its first invoice; what was set up during the trial carries over. Whoever sets up the workspace is responsible for keeping its sign-in credentials secure, and for the accuracy of the information added to it. Some roles (company owners and HR managers) are required to set up two-factor sign-in.
Plans, invoices and payment
Plans, their prices and what each includes are published on our pricing section. Prices are per company, in South African rand, and exclude VAT; VAT is added at the standard rate while SureWork is registered for VAT. A plan limits the number of people who can sign in and the file storage used, but never the number of employee records.
Subscriptions are billed monthly or, where a plan offers it, yearly. SureWork issues an invoice for each billing period, which is due by the date shown on it. You can pay by EFT into the bank account on the invoice, using the invoice number as the reference, or by card where card payment is offered. Card payments are processed by Stitch; if you save a card, it can be charged automatically when your subscription renews.
An upgrade takes effect straight away, with an invoice for the difference over the rest of the current period. A downgrade, or a move from yearly to monthly billing, takes effect at the end of the current period. If we raise a plan’s price, we tell you at least 30 days before it applies to your subscription, and it applies from your first renewal after that date.
Cancelling
The Owner can cancel at any time in Settings. Cancellation takes effect at the end of the current billing period: you keep full access until then and aren’t invoiced again, and you can change your mind before that date.
Acceptable use
You may use SureWork only for your own company’s lawful administration. You may not try to access another company’s workspace or data, attempt to bypass the platform’s access controls, or use the service in a way that could disrupt it for other customers.
Your data
Your company owns the employee and company data it puts into SureWork. We process it only to provide the service, as described in our privacy policy.
Changes to the service
SureWork is under active development. We may add, change or remove features, and we’ll try to give administrators reasonable notice of any change that removes something they rely on. The service is provided as it stands, without a guarantee of uninterrupted availability.
Suspension and termination
If an invoice is still unpaid well after its due date, we’ll remind the Owner, and then pause access to the workspace for everyone until it’s paid. The reminder emails give the date this will happen. While access is paused, the Owner can still sign in, but only to pay the outstanding invoice, and paying it restores access. A subscription that stays suspended for non-payment for a long period ends.
We may also suspend or terminate a workspace that breaches these terms, or that we reasonably believe is being used unlawfully or to access another company’s data.
Liability
SureWork is provided without warranties beyond those the law requires, and, to the extent the law allows, we aren’t liable for indirect or consequential loss arising from your use of the service.
Governing law
These terms are governed by the law of Needs a governing jurisdiction — set jurisdiction in src/lib/legal.ts.
Changes to these terms
If we make a material change to these terms, we’ll update the effective date above and let administrators know.
